Love Shop Laws in Specific States
Did you know that shopping in a sex shop in Alabama could land the owner in jail? Within the state of Alabama, there are some interesting laws that intend to regulate who is buying sex toys and why! I know it’s hard to believe yet it’s true. The laws even went as far as requiring a hard copy document verifying a medical diagnosis for a penile erection disorder or dysfunction or the like. A similar note from ones Doc is required for women if they have difficulty becoming sexually aroused. In addition, it is said (could be a rumor) that a woman is required to be approved by her counselor also, proving she needs sex aides to save her marriage. How embarrassing is THAT in a local sex shop?
Here are some specifics;
In 1999, an assistant attorney general in Alabama State made a comment on a court case involving sex toys. It was mentioned how sex devices were eventually used in their own opinion. It was stated that there’s no “fundamental right for a person to buy a device to produce orgasm”. In addition believe it or not, a federal appeals court upheld the Alabama State law prohibiting sex toy sales on Valentine’s Day in the year 2007. In addition, the so-called Anti-Obscenity Enforcement Act of the year 1998 was upheld by the Alabama State Supreme Court on the 11th of September 11, 2009.
In other states, In February 2008, a federal appeals court overturned a Texas statute banning sales of sex toys and was considered a violation of one’s right to privacy under the 14th Amendment of the US Constitution. Lawrence vs. Texas is another interesting case. So know your rights in certain states before going shopping.
